¿Se puede denunciar cuando se queden con los materiales para fabricar un objeto?

Tengo la duda,

 

Si acuerdo con alguien que me fabricara un determinado ítem y le entrego los materiales pero no entrega el item ni devuelve los materiales puede ser motivo para hacer una denuncia? y que pruebas debo presentar?
